Could you create a username for yourself? Alexander Chen listed 4 things in his comment, but Tim Rohr only chose to address the first two. The evidence he used to support his claim was the March 7, 2012 Apostolic Delegate letter to Archbishop Apuron. The letter listed Canon Law 537. Unfortunately for the Apostolic Delegate, his advice to Archbishop Apuron went against the Canon Law he cited. 


According to Canon Law Made Easy: 


"The Code of Canon Law (537) mandates Parish Finance Councils in each parish. The role of the Parish Finance Council is to assist and advise the Pastor in overseeing and controlling the financial affairs of the parish, including any schools. The Parish Finance Council is accountable to the pastor who has the responsibility for final decisions. If the advice of the Parish Finance Council is unanimous on a given matter, the pastor will give serious consideration to the recommendation."

The Archbishop does indeed have the final decision on the Parish Finance Council. And if there is a unanimous vote in the Parish Finance Council, the Archbishop will give it serious consideration to their recommendation. And that is all their unanimous vote means......a recommendation. The Archbishop makes the final decision. He can choose not to follow the Parish Finance Council. 


Furthermore, the Canon Law is much higher than the letter of the Apostolic Delegate cited by Tim Rohr.

Sigh.

Poor Diana does not even know the difference between a parish and a diocese:

DIANA: "The Archbishop does indeed have the final decision on the Parish Finance Council."

Ummm, no. The Archbishop does NOT even preside over the Parish Finance Council. The PASTOR does! That's why it's called a PARISH finance council and NOT a DIOCESAN finance council! SMH. 

Per Can. 537, the only involvement of the diocesan bishop in the operation of the parish finance council is to issue "norms" and is only to "assist the pastor in the administration of the goods of the parish:"

"In each parish there is to be a finance council which is governed, in addition to universal law, by norms issued by the diocesan bishop and in which the Christian faithful, selected according to these same norms, are to assist the pastor in the administration of the goods of the parish..."

By contrast the DIOCESAN finance council is very different in that the bishop needs the consent of the finance council to "alienate the good of the diocese:"

Can. 1292 §1. ...when the value of the goods whose alienation is proposed falls within the minimum and maximum amounts to be defined by the conference of bishops for its own region, the competent authority is determined by the statutes of juridic persons if they are not subject to the diocesan bishop; otherwise, the competent authority is the diocesan bishop with the consent of the finance council, the college of consultors, and those concerned. The diocesan bishop himself also needs their consent to alienate the goods of the diocese.

Also note the following clarification from ON CERTAIN QUESTIONS REGARDING THE COLLABORATION OF THE NON-ORDAINED:

Art. 5. § 2. Diocesan and parochial Pastoral Councils and Parochial Finance Councils, of which non-ordained faithful are members, enjoy a consultative vote only and cannot in any way become deliberative structures. Only those faithful who possess the qualities prescribed by the canonical norms may be elected to such responsibilities.

Notice the particular council this section leaves out. 

It states that Diocesan and parochial Pastoral Councils and Parochial Finance Councils enjoy a consultative voye and cannot in any way become deliberative structures. Notice that DIOCESAN FINANCE COUNCILS  are not mentioned because in fact DIOCESAN finance councils DO in fact enjoy a deliberative vote in certain cases such as that which is denoted in Can. 1292. 

Dear Diana. You are right to keep your pseudonym. I'd do the same if I was that ignorant.

In today's PDN story, Pius the Samnut says something worth noting: 

“Besides, these former finance officers of the Archdiocese are all my friends, some of them very dear, and brothers in Jesus Christ and I do not feel comfortable in wrangling and arguing publicly with them,” Sammut said.

Pius has had no problem "wrangling and arguing publicly" with anyone else over the last 3 years. What's different about "these former finance officers" who are "very dear, and brothers in Jesus Christ."

It appears that Archbishop Hon could use the advice of someone who can read Canon Law. Listed as members of the Archdiocesan Finance Council on the Archdiocese of Agana website are:

Note: While the objectivity of finance council decisions by neocatechumenates (Ada and Quichocho) can certainly be questioned in matters related to RMS (Quichocho is also RMS Board Treasurer), and David C. Quitugua is demonstrably ethically compromised (certificate of title), we'll leave those issues aside for now and continue with the following. 

There are a couple of problems here. The first is that Deacon Dominic Kim is also the Archdiocesan Finance Officer:

Given what we are about to expose, it is important, especially for newcomers, and more especially for Vatican readers, to recount the absolutely despicable behavior of Msgr. David the VG in December of 2011.

Dear Archbishop Apuron,

These are undoubtedly trying times for the Catholic Church here in our island.  I am writing to you because I continue to be saddened by the problems facing our beloved Church in Guam.  It is undeniable that our Archdiocese is clearly divided, and that many of our people are angry, distraught, and confused by all the discord within our Church and among our leaders.  The people of the Archdiocese – and even the many in our island community who are not Catholic but who are nonetheless concerned for our island – are all looking to you to provide resolution, healing, and closure. Unfortunately, rather than bringing about resolution, healing, and closure, it is clear that information released by the Chancery has only served to further inflame the situation rather than quell it.

With that said, I pray that you take what I am about to say positively, for my sole intention is to offer my thoughts in an effort to foster understanding, reconciliation, and ultimately the restoration of peace and unity within our fractured Church.  I understand that there are numerous issues that need to be addressed, but I wanted to specifically focus on the one area that I believe can be immediately improved: the area of finances.

CALL HIM A LIAR

All of us have human weaknesses and failings, and when we encounter them in others we are obliged to forgive them their trespasses as we ourselves pray to be forgiven. But while human weakness and failing is one thing, bold-faced intentional lying is quite another, especially when those lies are employed to "bear false witness" against another. 

One of the most difficult things for the Catholics of the Archdiocese of Agana to believe is how they are systematically lied to by their Archbishop and by those who represent him. However, as the evidence continues to spill forth, it is getting increasingly less difficult to believe. 

On this blog we have documented lie after lie after lie: the lie about Joseph Lastimoza, the lie about Fr. Paul, the lie about Redemptoris Mater Seminary, the lie about Msgr. James, the lie about the John Paul II Seminary, the lie to Aaron Quitugua, the lies, the lies, the lies...documented in detail if not the Archbishop's own recorded words. 

The sad part is that the Archbishop is simply lying and having others lie for him at the order of his Neocatechumenal Masters who need the Archbishop to stay standing for a few years longer so they can keep pumping out presbyters that probably couldn't get ordained anywhere else. 

Archbishop Apuron is welcome to his lies. Everyone can see through them and by his pathological lying he has made a mockery of himself and the Catholic Church on Guam. However, when his lies slander and malign other people, he must be engaged. 

Fr. Pius, while he pretends to be the Archbishop's servant, is actually his lord and master. He is also the Chancery-liar-in-chief. And one of his most persistent lies is about why the Archbishop fired four of the five members of the former Archdiocesan Finance Council. 

The members who were fired were Richard Untalan, Msgr. James Benavente, Sister Mary Stephen Torres, RSM, and Joseph Rivera. The only member not fired, Msgr. David C. Quitugua, the Vicar General. 

Fr. Pius tells people that these members were fired because they were trying to sell the seminary property. The next time he says this call him a "liar". In fact, SHOUT IT. The truth is that Archbishop Apuron was attempting to convey the title to the property to RMS, a corporate entity separate from the Archdiocese of Agana and controlled by a sleazy neocat New Jersey based Board of Guarantors.

The following letter from Richard J. Untalan, who was the then-president of the finance council shows that the request to convey the title to the property "on which the Seminary is located" came from Fr. Pablo Ponce Rodriguez, Rector of RMS. Of course Fr. Pablo was only the official pass through. The real "request" (an order actually) came from Giuseppe Gennarini, Archbishop Apuron's other lord and master. 

Thank God for brave people like Mr. Untalan and the others who incurred Archbishop Apuron's wrath and still must endure lies told about them by their own bishop.
