YES, IT WAS EDIVALDO

According to a KUAM news story, Judge Michael Bordallo has dismissed the slander portion of the defamation lawsuit against Apuron by those who have accused him of sex abuse, but NOT the libel portion.

First, let's understand the difference between slander and libel:

"Libel and slander are types of defamatory statements. Libel is a written defamatory statement, and slander is a spoken or oral defamatory statement."

It's easy to see why the judge dismissed ONLY the slander portion (the spoken part) of the suit. In Apuron's video statement of May 17, 2016, the day Roy Quintanilla accused him of molesting him, Apuron only denied the allegation.

The libel part came in the press release of May 31, 2016, and it was aimed directly at Doris Concepcion:

"Another malicious and calumnious accusation against the Archbishop has surfaced; this time from the mother of a man who has been deceased for eleven years."

It's one thing to deny an allegation, it's another thing to accuse the person making the allegation of being "malicious and calumnious." That's defamation, especially since Doris was only sharing what her dying son had told her, and it is libel, because it was written. 

This is what got Apuron in trouble...and HE STILL IS.

However, the real target of the statement was Tim Rohr. In fact, "Tim Rohr," was the only person named in the defamatory  press release. Here are all the things Apuron accused Tim Rohr of:

Tim Rohr and his associates launched a vicious and calumnious attack on the Archbishop and the Church
Thus began a malicious campaign to denounce and attack the Archbishop...
The perpetrators of these calumnies have resorted to insults and violence revealing their true intention to destroy the Catholic Church...
Their method is to confuse and mislead the faithful, even to the point of inducing some to bring false testimony...
Those who are orchestrating this campaign are inciting people into hatred of the Archbishop and the Catholic Church. 
They have produced scandal, confusion and grave errors with the cruel intent to injure the Archbishop, the Catholic Church in Guam and many other people of good will who have been outraged and harassed. 

He then threatened to sue Tim Rohr civilly and canonically:

Therefore, the Archdiocese of Agana is in the process of taking canonical and legal measures against those perpetrating these malicious lies.

Never mind the plural references ("those" etc.). There was only one person publicly standing up against Apuron at the time and it was Tim Rohr. That's why the press release uses "associates," and doesn't name anyone else.

And to his threats Tim rohr responded: "Bring it on."

Rohr, who writes about the local Catholic Church on his blog site JungleWatch, said Tuesday he welcomes the legal action that the Archdiocese is planning, hoping that everything will be revealed in court. 
“Bring it on,” said Rohr.

So why did Tim Rohr say that? Why wasn't Tim Rohr afraid?

Because Tim Rohr knew it wasn't Apuron who said any of the above. By May 31, 2016, Apuron had already fled Guam and begged for help from Papa:

So who was it who was threatening Tim Rohr?

It was Adrian and Edivaldo, the two impostors who had been running things all along. How does Tim Rohr know this? Here are the reasons:
  1. Apuron had not been running this diocese for a very long time.
  2. Adrian, Edivaldo, and the other neocat hierarchy were the real orchestrators, something the infamous "fist pump" video shortly gave away. 
  3. Apuron had already fled Guam.
  4. The press release was sent out by Edivaldo.


Thus, Tim Rohr prepared his own brief for a defamation suit against Adrian and Edivaldo.

The trouble for Apuron was that Adrian and Edivaldo didn't put their names on it and sent it out on chancery letterhead - which made Apuron liable for libel, and still does.



Thus Edivaldo brought down the very man he was trying to protect.

By "coincidence" the following message was received just minutes before KUAM released it's story:

This morning, since I had the day off, I went to morning mass for Ash Wednesday. I was taken aback by a priest I've never seen before at my parish. He was popular with the school kids in attendance and his sermon seemed alright. 
After mass, I met with him to ask his name. He spewed it out with an air of arrogance, as if I weren't supposed to register it. Little did he know I know Portuguese and could understand...yes, it was Edivaldo.

The KUAM story ends with this from "the trained lawyer:"

"He is outside of Guam. Why? Would you be able...to live in this very small, close knit community in the difficulty that exists? That's just the equation for another heart attack, frankly. And so yes, there is a factor of a medical condition - but it's also common sense." 

Ummm, no. It would have been "common sense" not to run if he had nothing to run from.

CRY BABIES!

When I look at the faces of Adrian and Edivaldo (at their recent appearance in Miami) and remember all the lies, the sneers, the deception, the fist pumps, and the sheer hell these two polluted excuses brought on our diocese, I can think of no other description of them but "evil." 

However, "evil" gives these two too much credit. Someone in a recent comment called them CRY BABIES. And that description seems a lot more apt. Not only did the two of the bawl, and cry, and kick their feet at their new assignments (Adrian to Umatac and Edivaldo to DOC), they both have a long history of tantrums and pouting, especially Adrian. 

Edivaldo we can probably even overlook since he was probably only seduced into RMS by the boy-loving Tony. And once here, was fed with the fat stuffings from Tony Boy's fleshy table. However, Adrian is another matter. 

He has been a cry baby for decades, pouting and throwing tantrums (as well as actual material objects) whenever he didn't get his way or when he felt he was overlooked, like when he got passed up for the "Msgr." label, or when he felt he wasn't getting paid enough

Pray for the salvation of their souls but don't ever feel sorry for these two. They chose their paths. They chose themselves over the truth, the salvation of souls, and the good of the Church. And they still are.

Like you, I was initially concerned that the one year "vacation" for Edivaldo was another reward a la Adrian (though I still don't know how March 7, 2017 to October 1, 2017 adds up to one year).


It appears that is not the case.

A credible source has revealed that Neocatechumenal presbyter Fr. Edivaldo Da Silva Oliveira departed Guam this morning for Denver Colorado, a Neocatechumenal Mecca.  One source said that he was "transferred."  Another said, "It's for good."

In case you do not understand the revulsion against the boy you've been seen palling around with (that's what it looks like) the last few days, here is but one example. 

While we understand that you are a good man and a good priest and want to bring healing and forgiveness, for several years the boy you've been palling around with has used his exalted position in our Church to harm the faithful, especially the young, by psychologically masturbating out his pent up sexual frustration from pulpits your archdiocese (it's yours now) gave him.

THE PRIEST AS PUBLIC PERSON

Priests, who in the capacity of their ministry, serve publicly, such as bishops, pastors, teachers, chaplains, rectors, chancery or curial officials, are not private persons. Like their lay counterparts, especially in the matter of governance, they wield considerable authority and influence over the lives of the people who are entrusted to them and can and should be held publicly accountable when they violate that trust. 

When a government official, let's say a mayor, is legitimately removed from his position and he absconds for several days with the office vehicle, he doesn't just get to show up at the governor's house and work out a deal where there will be no public consequence for his actions. The governor might "forgive" him but the mayor's action was a crime against the people, not the governor. Thus, there are public consequences. 

WHEN THE ARCHDIOCESE OF AGANA SUED ME

Prior to the two Media Releases already noted in my previous post, another Media Release was sent from the Chancery to the Media on May 13, 2016. The Release was attributed to:

Fr. Edivaldo da Silva Oliveira
ARCHDIOCESE OF AGANA, Media Relations
196 Cuesta San Ramon
Hagatna, Guam 96910-4334

In his Release, Fr. Edivaldo da Silva Oliveira, accused "they" (which is the CCOG and Tim Rohr) of:

  1. initiating "a series of lies destined to undermine the authority of the Archbishop"
  2. spreading a "series of intentional and malicious lies"
  3. causing "insults, calumnies and violence"
  4. deciding "to attack directly our Archbishop with a full-page paid advertisements in the Guam Pacific Daily News, at a cost of thousands of dollars, seeking to insinuate criminal sexual abuse by the Shepherd of the Catholic Church"
  5. attempting "to confuse and mislead the people or, even, to induce some to bring false testimony"
  6. making "insults and instilling hatred, ignorance and violence in the people"
  7. not being "Catholic nor Christian"

NO MORE MISTER NICE GUY

Fr. Edivaldo da Silva Oliveira and Fr. Adrian Cristobal, priests of the Archdiocese of Agana, used the office of the Archdiocese of Agana to publicly attack me as follows:

On May 31, 2016, a Media Release was sent from the Chancery Office of the Archdiocese of Agana to the local Media. The email message to which the Release was attached identified the person responsible for the Release as:

Fr. Edivaldo da Silva Oliveira
ARCHDIOCESE OF AGANA, Media Relations
196 Cuesta San Ramon
Hagatna, Guam 96910-4334

The Release dealt with, inter alia, me, Tim Rohr, and states in pertinent part:

  1. Tim Rohr and his associates launched a vicious and calumnious attack on the Archbishop and the Church. 
  2. They demanded that the Archbishop return to the former ways of financial administration… 
  3. They wanted to sell the seminary in Yona… 
  4. The perpetrators of these calumnies have resorted to insults and violence revealing their true intention to destroy the Catholic Church…
  5. They have…cruel intent to injure the Archbishop, the Catholic Church in Guam and many other people of good will who have been outraged and harassed.

The accusations against me, Tim Rohr, contained in this May 31, 2016 Media Release, were published and/or broadcast in the local Media as follows:

AB HON PUT HIMSELF BETWEEN A ROCK AND A HARD PLACE

Here's the rock.  Para. 20 of the amended complaint where Roy, Doris, Walter and Roland sued Apuron and the Archdiocese we find this allegation, "...May statement was prepared and released by Oliveria on behalf of Apuron and the Agana Archdiocese." Para. 14 is similar but alleges that Oliveria was the Media Coordinator for the Diocese and Apuron's personal secretary. The complaint alleges that the statements are libelous.


Here's the hard place. Krystal Paco's report on the July 25 KUAM News:

"According to the $2 million dollar libel and slander suit against the archdiocese and Apuron, plaintiffs allege such statements were prepared and released by Father Edvilado Olivieras. According to Hon, there's no proof Father Edivaldo was ever appointed the church's official spokesperson."

IT'S TIME TO THANK EDIVALDO

I will have something more extensive about Bill Pesch's column in today's PDN later, but for now let us note that Pesch's column not only clarifies in layman's terms the nature of the current civil suit for libel and slander, but permits us to once again note this extreme example of what we have to call KARMA. 

Since Apuron brought a certain Brazilian named Edivaldo Da Silva Oliveira to Guam in the early 2000's, Oliveira has noticeably been Apuron's pet - almost constantly at his side, as he was for Apuron's recent escape from Guam. 

Oliveira (aka Edivaldo, Orange Juice, Edi, Edi the Waldo, or just "Waldo") has taken advantage of every bit of his privileged treatment. Puffed up with himself he strutted about Guam as if he was on the fast track for Guam's next bishop (and no doubt that is what Apuron would have liked). 

When things recently took a turn for the worst for Apuron, Edivaldo busted into the chancery and took over, casting himself as the chancery's spokesman but obviously he (along with Pius) was much more than that. 

On May 13, he publicly broadcast a major hit piece on myself and the CCOG. Then on May 20, he directed Deacon Tenorio in his infamous short film feature "The Deacon goes Dakon," featuring "Edi" himself as the writer, director, producer, and the only other actor in the film - his fist pump being caught in the reflection in the glass behind Tenorio when Tenorio uttered a key line - obviously written by "Waldo." 

However, his all-star performance really came on May 31, 2016 when he handed us the opportunity we were waiting for: A CHANCE TO GET APURON INTO COURT. 

Oliveira publicly released a hit piece on Doris Concepcion (the mother of the now deceased Sonny Quinata), accusing her of making: "Another malicious and calumnious accusation against the Archbishop.

In the same hit piece he named myself and my "associates" and blamed us for: insults, violence, the destruction of the Catholic Church, confusing and misleading the faithful, provoking false testimony, inciting people to hatred, orchestrating scandal and confusion, grave errors, and attempting with “cruel intent to injure the Archbishop” and the Catholic Church. 

I am sure that Oliveira was quite proud of himself and he should be. He was able to do something - in fact two things - that I, after 3 years, had not been able to do myself: 1) get the Pope to take immediate action, and 2) provide a legal path to get Apuron into court. 

How "Karma-tic" that Apuron's boy-toy, his precious Edivaldo, is the one in the end to bring down Apuron's Thirty Year Reign of Terror and bring about Apuron's own "arduous and painful closure" to his assignment - which will soon be followed by that of Edivaldo Da Silva Oliveira.

LOOK AT HIM GOOD

You know Waldo, I was going to have some fun with your demonstrable stupidity, but I'm having a hard time finding any fun in your first statement:

Then take another look at the ASSHOLE who accused this heartbroken mother of a "malicious and calumnious accusation against the Archbishop." Look at him. Look at him good.



This is what you've been paying for, Catholics of Guam. This is what twenty years of supporting Apuron's RMS has brought you. The above pile of excrement. Look at him good.
