THE CASE FOR THE ILLEGAL ASSIGNMENT OF PROPERTY TO A THIRD PARTY BY THE ARCHBISHOP OF AGANA

On November 22, 2011, ARCHBISHOP OF AGANA, A CORPORATION SOLE, ANTHONY SABLAN APURON, OFM. CAP., DD., INCUMBENT assigned perpetual use and control of the property on which THE REDEMPTORIS MATER ARCHDIOCESAN MISSIONARY SEMINARY is situated to THE REDEMPTORIS MATER HOUSE OF FORMATION, A GUAM NON-PROFIT CORPORATION.

There have been many questions as to whether this act was illegal under Guam Law, and if it is, would the faithful of the Archdiocese of Agana have standing to sue for its return if not also for fraud. 


The argument against illegality has thus far been that the ARCHBISHOP OF AGANA is a corporation sole, and is thus fully the owner of the property and as the owner is empowered to do as he wishes with the property, which is in fact what he did - proceeding with the ASSIGNMENT against the advice of the archdiocesan legal counsel, and without the consent or knowledge of the finance council and the college of consultors. 

However, I propose here that the DEEDING of said property for perpetual use to THE REDEMPTORIS MATER HOUSE OF FORMATION is a violation of Guam law.

Title 18, Chapter 10 of the Guam Code addresses the requirements for the formation and responsibilities of a religious corporation or a "corporate sole", which, the Archbishop of Agana, is.

According to § 10105 Property to be Held in Trust:
"...all temporalities, estates and properties of the religious denomination, society, or church theretofore administered or managed by him as such bishop, chief priest, or presiding elder shall be held in trust by him as a corporation sole for the use, purpose, behoof, and sole benefit of his religious denomination, society, or church..."
Thus, the ARCHBISHOP OF AGANA is not the owner of archdiocesan property but its TRUSTEE with the members of his church, the BENEFICIARIES. And Guam law requires said TRUSTEE to administer and manage said property for "the use, purpose, behoof, and sole benefit" of the BENEFICIARIES.

Now, let's take a look at the purpose of the REDMPTORIS MATER HOUSE OF FORMATION:

ARTICLE III
PURPOSE.

The purpose of the Corporation shall be to establish and conduct a House of formation to prepare men for the priesthood for the new evangelization following the life and practice of the Neocatechumenal Way...
The Neocatechumenal Way, as per the STATUTE OF THE NEOCATECHUMENAL WAY (2008) is only...
“...one of the forms of diocesan implementation of Christian initiation and of ongoing education in the faith.” Art. 1. § 2.
As it is only "one of the forms" of "Christian initiation and ongoing education in the faith", it is by definition NOT for "the use, purpose, behoof, and sole benefit" of the entire Catholic faithful of the Archdiocese of Agana.

In addition, the fictitious business name of the Corporation is THE REDEMPTORIS MATER ARCHDIOCESAN MISSIONARY SEMINARY OF GUAM. Both in this name and in its practice, the priests formed at the REDEMPTORIS MATER HOUSE OF FORMATION are sent to serve in other dioceses and thus are NOT formed for the "sole benefit" of the BENEFICIARIES of the TRUST for which the ARCHBISHOP OF AGANA is the TRUSTEE.

  1. I have a serious concern that the neos established a vehicle for money laundering. The way they handle money smells corruption. Their trash bag style accounting of funds is a hot bed for abuses, laundering and 'directed reassignment' (aka stealing) of large amounts of money. I am not surprised if federal authorities have a whole lot of concerns about this kind of money management.

    2. You're right, definitely money laundering as they are using the church to evade taxes. The IRS stands to recover meeelions and meeelions of dollars.

    3. Miss/Sir Diana argued once that since NCW does not or cannot own property and does not or cannot run any businesses, they have no obligation to account for any funds at all, including funds and property apparently collected in trash bags. Diana cannot be wrong can she?

    5. Not really sure this is the IRS's department since they are under the Church. I don't believe they have to file with IRS except for employee reports on US or US territory residents.

Not afraid of the unknown, more afraid of the known italian mob orgs. well placed in neo. Guam may have been the perfect patsy w/establishment of rms. dang!

    1. Exactly my thinking. Woww! Even Islamist radicals may infiltrate their ranks. Not only on island but everywhere, especially on the mainland or in Europe. All they need some responsibles and catechists in their pocket and they own the whole neo machinery. My goodness, Kiko, what kind of people are you harboring in the darkness of your sect?!

    1. Evil sect operating now in the pacific island paradise of Guam. The sect chose Guam as an easy target to control Anthony Apuron by his love of money. Apuron gain vast amounts of personal money. In return Apuron would ordain subjects of Kiko for his cult. Apuron was used. He did come very close to being made a cardinal but thank God through the good work of Tim Rohr and his ability to correctly document and present facts in truth the Vatican at least listened. without the communication skill of Tim Rohr I fear we would never have got this far. watching him on KUAM last night I see what a blessing he has been to the entire pacific church.

  7. Guam is small easy diocese to manage. appears to readers the NCW divided the church of Guam by buying off the ordinary to ordain priests for them. Very unfair they attempted to tie up this seminary to their control well after the retirement of the present archbishop. this is where things are seriously wrong their desire to control the pacific region for ecclesial power to carry on building their own church within the Church of Rome. This is the evil.

  8. Valuable information from the chancery past 48 hours indicates in house division between the NEO members. In house fighting between the NEO members on who is administering and decision making.

    There is no full time professor with a Ph.D. in theology at RMS. No requirement is satisfied, no quality control is fulfilled. How do you make sure your seminarians do not obtain a fake education?

    Do you not keep up with the news? This is why Archbishop Convoloo on was on Guam last December to certify the Redemptoris Mater Seminary. That was only last month.

    1. Bishop Covolo is the Rector of the Pontical Lateran University to which the Blessed Diego Institute has an affiliation, and by which BDI’s charter to act as a real educational institution depends.

      BDI initially established the affiliation with the Lateran in 2007. However, such affiliations have to be reviewed just as accreditations must be reviewed.

      This is what we believe Bishop Covolo was doing here in Guam in 2013.

      It is instructive to note that the Umatuna article on Bishop Covolo’s visit (Dec. 29, 2013) only notes that he was here to visit with faculty and students.

      That is misleading. He was here to review the institute to see if it was in conformance with the provisions which would allow BDI to continue to use the Lateran affiliation.

      The fact that there was NO follow up story celebrating the renewal of the affiliation should tell us something. We should also note that Bishop Covolo was called to meet Pope Francis on the same day Archbishop Apuron met with Pope Francis on Nov. 21, 2014.

      In hindsight, though Apuron tried to position it as a cordial meet and greet with the pope complete with non-indigenous “Guam chocolates, it is very possible that Covolo was called to give his report about BDI to the Pope, the pope figuring “while you’re in town” about Apuron.

      We can speculate about this because within days of Apuron’s visit he gets a notice that he will be getting a “visit” from Rome and the delegation included a seminary specialist, Fr. Nowak.
