Attorney General, Douglas Moylan, has filed BRIEF OF RESPONDENT with the Supreme Court of Guam relative to LLG’s “Request” to the Court for Declaratory Judgement on “the validity and enforceability of Public Law 20-134.”
It’s worth a serious read for anyone who cares about the fate of Guam’s unborn, but also because this may very well go to a referendum.
Of particular note is Pg. 2 of Mr. Moylan's Brief wherein he states:
The Government of Guam (the Attorney General) joins with the legal position of amicus curiae of former Senator Robert Klitzkie, who contends in his brief that this High Court has no jurisdiction over this matter due to the Petitioner’s (LLG's) lack of standing. (Parenthetical comments added)

I don't know if AG Moylan is pro-life or not. It doesn't matter. He's just doing what he was elected to do: his job. Someone tell the Governor. Thanks.
ReplyDeleteTim, just a heads up to take a look at a new bill on the legislature website. Bill No. 106-37 (LS) will have a referendum on abortion at the next general election in November 2024.
ReplyDeleteHow will the Church respond? Here's what the two sponsors of the referendum bill said before the election. Fisher: "In this case, SCOTUS (Supreme Court of the United States) put the decision in our hands, and I believe the voices of the people of Guam should be heard through a referendum." Muna-Barnes: "This issue is too complex to answer with a simple yes or no, or pro-life or pro-choice. I personally chose life, but I also believe no government should have the right to tell women what to do with their own body."

DeleteAs to how will the Church respond? The Church should do NOTHING other than quote the Catechism of the Catholic Church:
Delete2271 Since the first century the Church has affirmed the moral evil of every procured abortion. This teaching has not changed and remains unchangeable. Direct abortion, that is to say, abortion willed either as an end or a means, is gravely contrary to the moral law:
You shall not kill the embryo by abortion and shall not cause the newborn to perish.74 God, the Lord of life, has entrusted to men the noble mission of safeguarding life, and men must carry it out in a manner worthy of themselves. Life must be protected with the utmost care from the moment of conception: abortion and infanticide are abominable crimes.75
2272 Formal cooperation in an abortion constitutes a grave offense.
The Church attaches the canonical penalty of excommunication to this crime against human life. "A person who procures a completed abortion incurs excommunication latae sententiae,"76 "by the very commission of the offense,"77 and subject to the conditions provided by Canon Law.78
The Church does not thereby intend to restrict the scope of mercy.
Rather, she makes clear the gravity of the crime committed, the irreparable harm done to the innocent who is put to death, as well as to the parents and the whole of society.
Our problem has always been our clerics being bated by the media into lecturing from the pulpit and teaching as if it is their teaching. Quote the Church. Tell people where they can read it for themselves. And leave it.
