JOE ASKS: CAN "THE PROPERTY" BE RETURNED?

    Should Rome take action regarding this situation is there any way that they could DEMAND that they return the title back to the Archdiocese? Or is this lost for good? such sadness....
    1. Yes there is a way. RMS can deed the property back to the Archdiocese of Agana. Both the Board of Directors and the Board of Guarantors would need to sign. According to the 2014 Annual Report, the current Board of Directors are:

      Archbishop Apuron
      Rev Pablo Ponce Rodriguez
      Danny Quichocho
      Susanna Juliana Jayasuriya
      Rev. Julio Cesar Sanchez Malagon

      The Board of Guarantors are:
      Archbishop Apuron
      Giuseppe Gennarini
      Claudia Gennarini
      Angelo Poschetti

      Very telling that aside from the bishop, there is only one local name.

    3. Rome cannot order Apuron to give the property back because as Attorney Bronze has demonstrated in his legal opinion, Apuron does not control RMS, the two boards do. Assuming the two priests (Pablo and Julio) are incardinated in this diocese, they would be the only two who would be bound by obedience to obey a direct order from Apuron.
    4. Perhaps if you know some of these people on the boards you may want to talk with them about giving the property back as more than likely they will be named as party to any suit that may be brought.
    5. The same people were on both boards in 2011 when Apuron executed the deed.

To End this conflict once and for all, The people call for the Board of Gurantors and the Board of Directors to deed back the property to the Archdiocese and should make a public announcement of their intention. This move will at least give the Archbishop some reprieve. Archbishop, this will indicate the level of support Kiko and Gennari have for you. The next move is from your side.

    According to the 2013 Archdiocese of Agana Directory, as of 11 January 2013, there is a Sanchez, Julio Cesar recorded as being Incardinated in the Archdiocese of Agana having been ordained by AAA on 7 November 2009, whereas Rodriguez, Pablo Ponce is not incardinated in this Archdiocese.

    The observation "Very telling that aside from the bishop, there is only one local name" must only refer to the RMS Board of Guarantors because there is another "local name" in the RMS Board of Directors, Danny Quichocho.

    Clearly, no matter what "The Diana" and the other Kikos/Kikobots might claim, AAA does not control RMS; AAA is a mere puppet whose strings are being pulled by the NCW. How very sad for all of us.

    4. I believe this string of conversation about last names was a result of my reference to there being only one LOCAL name among all the board members of RMS. I specifically said LOCAL meaning someone who is from Guam and did not mean to reference any ethnicity.

  5. Could not a full-fledged "title report" (if that is different from a PTR) fully reveal who the real owner of the property is? I mean, couldn't all this hoopla about "I own it; I am in full control; the Archdiocese owns; RMS owns it; the Board owns it; the Guarantors have the final say; etc." - coudln't all this be answered by a simple request of Rev-Tax to tell us WHO OWNS IT? And then take it from there. - Simple Simon.

    1. Actually no. That's why an attorney had to do it. Even a title company would have to use an attorney. Even then it would take a court challenge and a court ruling to define the actual owner definitively. The problem was planted purposely by Gennarini and Apuron in the initial drafting of the corporate docs and the deed restriction. It was purposely designed to throw just about everyone off the trail except for a skilled real estate attorney.

  6. The archbishop has maintained that he did not give away the Yona property, that he did not alienate the property from the archdiocese, that he is still in control of the property. Are these statements correct from the archbishop’s point of view? If the answer is yes, here are a few more questions:

    Does the board of directors of RSM hold the same views as the archbishop?

    Does the board of guarantors of RSM hold the same views as the archbishop?

    Would any or all of them sign an affidavit to that effect? If not why not?


    Unfortunately the answer would probably be the same as the answer to the other questions given to the archbishop: No response.

  8. Might these be merely two of the many examples archbishop refers to as his “initiatives for the good of the Church” and his “pastoral works that are doing so much good in our island”?
    1) his removal of two good, beloved non-neo priests from serving the Catholic faithful in two parishes; and
    2) his refusal to support and recognize a Guam son who sought priestly vocation formation at a Catholic, non-neo seminary in the Mainland!

    … well, he is “doing so much good“ for the European neo church on Guam since he enabled their acquisition of our local Catholic Church’s properties -- gratis! Yes, these are archbishop’s “initiatives,” alright!

  10. Rome could put a moratorium on the ordination of RMS seminarians in one or more dioceses until the property is deeded back, or suppress "the Way" in one or more dioceses until the New Jersey capos deed it back. Would that be likely?

  11. Interesting Dilemma

    If this case goes to court the archbishop will be arguing that RSM does NOT own the Yona property. How will this sit with the RSM board of directors and guarantors? Will they also be arguing that they don't own the property?

    If the court finds that the archdiocese still owns the property the archbishop may be in hot water with the NCW leaders. If the court finds that RSM owns the property the archbishop will be in hot water with the laity of Guam (and possibly Rome).

    A classic example of being between a rock and a hard place.

    3. As Frenchie has opined elsewhere, it is not only easy, it is quite common for a group like the NCW to control huge amounts of wealth without ever having actual possession of it. Non-profits are extremely effective vehicles for money laundering.

  12. Why is it so hard for those in the NCW to UNDERSTAND that the Archbishop is outnumbered where VOTES are concerned. The NCW OWNS 3/4 OF THE VOTES CONCERNING THE RMS..Apuron is nothing but and ANT a mere 1/4, a minority to those who control the WAY.

    Lastima! You could have been loved and respected by your own people, yet you chose to be loved by those who truly used and abused you. The sins of pride,and hunger for power and wealth cause the corrosion of you leadership.

  14. Is there any consideration to pursue the possible criminal charges of "Theft of Property" and "Theft by Deception" which based on the item's value and under Guam's law are 2nd degree felonies punishable by a minimum of 5 to 10 years of imprisonment?

    1. @2:05pm, I do believe that if this is the life these girls chose, then let it be. No need to bring them into the picture. There was no coercion. They did a dissernment for 2 years and could have opted not to enter.

      For you to state the phrase "slave trade" is something else. You make it sound as if Kiko was going to sell them off as prostirutes.

      If the parents asks for help so what! That is their business not yours. You need not contribute to the cause. If you do not contribute, then why are you complaining about funds for these girls. It is part of our culture to take care of our own. They are still a part of us in spirit.

      There is a difference between these girls in the monastery and the foreigners in the seminary. WE FUND FOR EVERYTHING, THEIR HOUSING, MEDICAL BILLS, EDUCATION , TRAVELS, FOR THE REST OF THEIR LIVES. Does the Archbishop ask to go fund me to the parents or diocese where the men come from, NO!

    2. You were doing good until you said "shut your mouth", but I permitted your comment anyway so I could provide my own. There is some truth to the reference to a "slave trade". No, the girls aren't being sold as prostitutes, but that doesn't mean they, and the men recruited to be presbyters, are not being "prostituted" by Kiko. Kiko uses their numbers to buy influence in Rome. In short, their numbers are "marketed." Supporting those vocations - even if they are authentic - is the same as supporting the presbyter factory we have here. Kiko needs numbers. We can only fear for the future of those girls when the Kiko-Gennarini-Pius syndicate comes crashing down. And it will.

    4. @4:41PM. Neo or Non-Neo, If you were a parent of one of these girls and they asked you for help won't you do it? If the heating system didn't work and it needed replacement but was going to cost over their budget, would you not help? Can you imagine being enclosed in a building for days during a heavy snowstorm without heat?

      I understand where you are all coming from, but read the post..the Neo Carmelites from Guam.. they are not the only ones there? I understand the word transparency. I understand the word favoritism. I understand the fact that our local priests are out in the cold.

      I am not angry, but rather upst. These girls chose to go there. They were not picked by lottery to go to NJ like the seminarians. If they choose to continue on and take their final vows then God be with them. If they choose to leave, then it wasn't meant for them.

      If my child asked for donations to help repair a convent that is run down, yes I would find ways and means to help. As for the Annual Appeal, no I will not give. How many RMS are ordained and afforded the opportunity to study in Rome for their Masters or Doctorate? Are our very own local priests afforded the same opportunity, No!

      Yes, I see the frustrations in many people and also the widening of the division in the Church. Yes, I have seen the good and not so good that the NCW has brought to people.

      Do I think there is honesty and sincerity in the heart of the Archbishop, No! Do I believe that there is something he is hiding, Yes!

      Guess what I am trying to say is, these parents, no matter what, will be there to help their child(ten) for as long as they are alive or for as long as they can. Are these parents asking for anything in return, No! Unlike the Archbishop, their motto for helping the NJ monastery is not "If you scratch my back, I'll scratch yours!"

      Just airing out my two cents. If you agree fine, if not it's fine.

Dear anons at 3.39 and 6.40: while I empathize with your wanting to make sure your relatives are taken care of, and without going into a semantic debate, I wish to point out a disturbing fact that you might have not considered, the man at the center of this whole situation: namely Pius Sammut.
      If it was anybody else, we were talking about, I would concur with your approach, it is after all a very personal call, that is life changing, and as such must be respected.

      The problem is not the Carmelite per se, or the fact that these young ladies were "steered" towards NJ.
      The problem is that Pius has an evil and shady past of lies, abuses and manipulations.
      As the then Superior of his order in Malta, his record was so poor and so evil, that he had to leave in haste to take refuge in frozen Canada to escape the wheels of justice, and the anger of some of the local families.
      This man's trail is littered with the discarded life of many wonderful people, and he continues unabated on his path of destruction.
      The Carmelite convent in NJ is one of the bastion of the NCW, and it is located just miles from the Genarini's residence.
      Like the RMS here it is being used as a laundry from some of the shenanigans Genarini and Pius are pulling on well meaning but delusional people.
      There is a wonderful Carmelite community on Guam.
      Have you ever wondered why Pius did not encourage your family members to embrace a religious life here, rather than uproot them away from familiar grounds, and support, should they need it?
      I would strongly suggest you educate yourselves on the tactics and manipulations cults use to make people do what they want, while they believe it is their own free will. You will be astounded.
      I will pray for discernment for you and your love ones.
      I sincerely hope they shall not be hurt in the process as countless young beautiful souls have been, under the "hospices" of the likes of Pius and Genarini.

    10. These young Girls could have entered Carmel on Guam. Pius manipulated these girls to enter in new Jersey purely to build up numbers. Pius only acts to support his own agenda. The agenda was to build up numbers in NJ convent. To impress Rome he needs money and numbers essential needs for his cause. Pius will do anything to protect himself and his manipulative evil ways. Do you honestly believe it right for the families of these girls to be in a carmel in America where they can rarely visit. On Guam families can visit Carmel. At same time our own Carmel needs novices to ensure the future. These girls would have been better off discerning vocation in Guam Carmel. Pius has manipulated this community . Frankly it's about time you ask the United States government to remove his visa since it may be the only way to remove him from causing further harm to this community. This is a very dangerous manipulative individual.

    11. I believe that even if the Archbishop resigns or is removed, Pius will always be that magnetic force and the young girls will still go to the Carmel in NJ. Who is to stop them unless the Carmel closes down..Fat Chance!

      I have seen the magnetic force that draws people to him. As soon as he walks into a room or even a church, NCW members automatically stand up to kiss his hand, touch his robe, his face, his head, etc. I have never seen people flock to the Archbishop to do such a thing, not even the members of the NCW.

      Pius on a video on one of the pilgrimages proclaims himself as being like the second Abraham when talking to the youths. He cites this by proclaiming he was the their parents' catechist and now the youths are like his grandchildren, just like those of Abraham the father of the Israelites. Remember the saying " The God of the Israelites, is the God of Abraham."

      If Rome does not move, what can we do? If the civil suit is not filed, what can we do? If people don't have the courage to come out to the meetings and the rallies, what can we do? Like it is said in this blog, Kiko has people who are very influential in the Vatican. What promises were made to them, they are the only ones who know. Is Krebs moving slow because he need to be careful of whose toes he steps on?

      Time will tell on how the Church and its people heal.

    12. Archbishop Krebs is only the papal delegate. He has no capacity to remove Apuron or to intervene in our business other than to help facilitate. The decision making must happen at the level of the Congregation and even the Secretary of State and then both must involve the Pope.

  21. speaking of the carmelites, it's now novena time for the feast of Our Lady of Mount Carmel, which is on july 16. i encourage people to pray the novena, especially for the Church on guam as one of your intentions.

    i think this is the first time i've ever heard of the new jersey "neo-carmelite" connection on island. how many have been sent out there?

    it's rather strange that guam women who are discerning religious life in carmel are being sent to new jersey. it doesn't make sense, when there's a guam carmel that's been here for decades. i'd be very surprised if the guam carmelites refused to accept any new postulants.

    in any case, my point here is: why new jersey? we all know the answer to that.

      rey d at 1:32 PM, thank you for the reminder that the 16 July feast of Our Lady of Mount Carmel — and the second anniversary of AAA's Public Persecution of Fr. Paul Gofigan — is only a few days away.

      As CNMI Lawyer suggested in another post, Mother Dawn and her nuns would be most grateful for any donations that can be sent their way. Instead of contributing to the weekly collection basket which AAA can easily snatch and send to his catechist, I suggest that we observe the feast of Our Lady of Mount Carmel by flooding Mother Dawn and her nuns with monetary donations between now and 16 July!
