IS DAVID THE DEVIOUS STILL THE VICAR GENERAL?

9:41AM is "still wondering why" Jeff was not appointed Vicar General:

The Church hierarchy has a command structure akin to the military. The Delegate to the Administrator (still wondering why Fr. Jeff was not appointed Vicar General and all appurtenances that accrue with that title)...

Here's a possible answer:

Can. 478 §1. requires that the vicar generals be priests who are "doctors or licensed in canon law or theology or at least truly expert in these disciplines.

Obviously Fr. Jeff isn't so he can't be the vicar general.


However, a diocese can NOT be without a vicar general:

Can. 475 §1. In each diocese the diocesan bishop must appoint a vicar general who is provided with ordinary power according to the norm of the following canons and who is to assist him in the governance of the whole diocese.

So either Hon has broken with Canon Law by not appointing one, or - and this is probably the reality - David the Devious is still the Vicar General. Let's take a look at Hon's "appointment" of Fr. Jeff as reported in the PDN:
Hon appointed the Rev. Father Jeffrey San Nicolas as delegate of the administrator, assuming responsibilities similar to those of the vicar general and moderator of the curia. A curia is a group of officials who assist in the governance of the local Catholic Church. San Nicolas assumed the post previously held by the Rev. Msgr. David C. Quitugua.
No, San Nicolas did NOT assume the post "previously held by" David the Devious. Fr. Jeff was given a wholly new position (delegate), and what's more Quitugua was NEVER removed as Vicar General.

Technically, he ceased being Vicar General when Apuron's authority was suspended according to:

Can. 481 §2. When the function of the diocesan bishop is suspended, the power of a vicar general and an episcopal vicar is suspended also unless they are bishops.

However, we know that after Hon arrived, Quitugua continued to function as the VG. This could not have happened had Hon authorized him to continue as the VG. 

Since David the Devious continued to function as the VG under Hon and because he was never officially (there was no decree) removed from that position, David the Devious may in fact remain the Vicar General. 

This could explain why Quitugua overruled Jeff on the LFM visit to the seminary. Quitugua is still the VG, making him actually in control of the diocese while Hon is gone. Jeff is only a "delegate," a position with no canonical status. 

Damn, these people are good.

    It could be possible Rome finds Apuron " not guilty" returns him as Archbishop of Guam. In this case the VG still remains VG
    Thought about a stage set where by Apuron does return. Possible. However, disunity would continue, lawsuits increase, Archdiocese divides. Dangerous ecclesial stage to support.

    1. It's a damn good thing we pushed forward on that legislation. In fact, it may be the very thing that will keep Apuron from coming back. However, it is not law yet. You can bet the Kiko's are working feverishly like Orks to get the governor to veto it and then to influence enough senators to uphold the veto.

      The bottom line is that without this bill signed into law, there is NOTHING keeping Apuron from returning and wreaking vengeance on everyone. There won't be a single legal thing we can do to stop him.

  2. Jeff will lose here unless Jeff himself is appointed Bishop.
    Jeff is not VG he has no authority. This is why he was blinded by power in accepting this useless position.
    He been better staying in FD.
    Unless Jeff becomes Bishop himself.
    For sure Archbishop Hon will leave Guam very soon.

  3. Its too bad that this VG is just as corrupt and devious if not worse than the bishop he should be advising. Isn't it the case that the more one is aware of what the law is and requires, the more one becomes accountable? This being the case, defrock Quitugua and replace with Fr. Carl, or Fr. Johnathan as VG, I believe these priests have JCD or JCL?

      Hon is good. He has conned a lot of people. It wont happen any more. We now see his true colors.

      He was definitely sent to prop up the kiko movement on Guam. He talks a good story but with forked tongue.

      Looks like its time for more people to register their utter contempt for everything we are going thru, and Rome sends us one wolf to replace to one who ran away. Run Hon. Run Apurun!

    2. Interesting that a VG is required to have a canon law degree. And if that degree is so important, it is even more interesting that Apurun made sure that only one person had such a degree.

      Even though it took David the vg 10 years to acquire a 2 year degree, Apurun made David finish. David was by design to be the VG until Apurun retired, thereby insuring that no other priest would that action against his serial sexual
      Predator activities.

      All this time Apurun could have sent other priests, good priests, to get this advanced degree. But Apurun refus d this opportunity to anybody else. And now we know why.

      Some will say there is Fr Carl and Fr Jonathan, but these men are not incardinated here. Apurun could spit them out at anytime. They were only useful to fill parish roles.

      Of course, there is always the sad case of Adrian the jokers wild. Apurun knew well Adrian did not have the mental capability to pass a canon law course. He could not even pass his seminary work, yet Apurun still ordained him. Adrian was ordained because he too knew all the dirty secrets in the archdiocese. Keeping him around insured he would keep quiet. He became a useful idiot.

      But eventually Adrian got greedy and grew ambitious. He wanted to be Vg, and not just head record keeper. So he enrolled in a matchbook, online course in canon law. And now he is nearing David's record in how long could it take to acquire a canon law degree, even a matchbook degree.

      Rome- we need real leaders, not wolves trying to protect other wolves. Send us a real bishop who will train real priests.

    Spiritual poverty caused because Archbishop Apuron himself is a deeply flawed human being.

    That canon law hierarchy Tim cites probably explains this power play situation. First, this is another example of the lack of consistency on the basis of the Church leadership’s decisions. In some instances the leadership follows canon law or a Church governance code. In some instances it doesn’t and follows instead the free-wheeling methodology of Church decision making. This is another example of why the mistrust for the Church’s decisions exists. Secondly, as it relates to reneging on the arrangement with LFM for a tour of the RMS, regardless of the titles “Vicar General” or “Delegate to the Administrator” there was an arrangement with the Church. Honor that arrangement. But since that arrangement was not honored (and was not honored in a really un-classy way, by way of a generic notice on a locked gate), it begs the questions: “What gives?” “What are you hiding ABOUT the RMS?” “What are you hiding IN the RMS?”
