DO YOU WANT TO TELL PEOPLE THE REST OF THE STORY...OR WILL YOU?

In today's U Matuna, the official newspaper for the Archdiocese of Agana, there is a front page article entitled "The truth about the property of the Redemptoris Mater Seminary."

The article attempts to persuade us that the property remains fully in Archbishop Apuron's control and that he did nothing wrong when he restricted the use of the property. It attempts to do this by presenting excerpts from the following:
  1. The Ownership Report
  2. The Legal Opinion
  3. The opinion of the Pontifical Council of Legislative Text
Let's take each one.

The Ownership Report
The article states that the Ownership Report, as completed in 2014 by Pacific American Title, "confirms that the lots on which the seminary sits, identifies the owner as the Archbishop of Agana. Therefore, contrary to rumors, the title deed has always remained in the hands of the Archdiocese."

Two points:

One
Yes, the title deed remains in the hands of the Archdiocese, BUT only thanks to the people Archbishop Apuron fired from the previous Archdiocesan Finance Council: Richard Untalan, Joseph Rivera, Msgr. James Benavente, and Sr. Stephen Torres, RSM. Let us recall that in 2011 Archbishop Apuron had initially attempted to convey the title outright to RMS as evidenced by this letter written in September of 2011 advising the rector of RMS of the decision by the AFC to deny the conveyance of title to RMS.

Two
The issue is not who owns the property. We already knew that from doing our own title search which we posted here back on March 27. The issue is not who owns the property but WHO controls it. You can have title to a property, but if you assign control of that property to someone else it no longer has any value as an asset for the duration of the assignment. 

The Legal Opinion
The article includes portions of a legal opinion by a Denver law firm assuring us that Archbishop Apuron:
  1. "retains substantial authority" over RMS
  2.  in restricting use of the property to RMS was an action "consistent with canon law"
Four points:

One
So a Denver law firm is practicing law on Guam. That's illegal.

Two
Why didn't Apuron simply get the (probably free) opinion of his own legal counsel? The man who actually put both the deal together to acquire the property and the RMS corporation itself? Well, we know why. Because the legal counsel had already given his opinion and it wasn't the one Apuron wanted.

Three
Apuron only posts portions of the opinion. Really? Space and cost were no object when he was publishing, week after week, all the supposed crimes of Msgr. James. But here we are given the few tidbits that he wants us to read and then tells us if we want to see the rest we have to come to the chancery.

Four
The bottom line issue is whether or not a lending institution would consider the property, given the restriction, an asset of the Archdiocese of Agana. In arguing only for the view that the archbishop retains "substantial authority" over RMS, the report appears to admit that the property has no current value to the Archdiocese of Agana, and would only have value if the Archbishop assigns it back. In short, the patrimony of the Archdiocese of Agana is significantly harmed, which is is why then apostolic delegate, Archbishop Balvo, told Apuron in 2012 that in this matter he is not free to do as he pleases. 

The opinion of the Pontifical Council of Legislative Text
The article references a Canon Law Report which supposedly claims that the deed restriction did not alienate the property. 

Two points:

One
Hmmm. There is no footnote to this report (as there is for the law firm's opinion). Why not publish the "report"?

Two
The "report" references the Pontifical Council for Legislative Texts and we are told that it is the highest authority for interpreting the laws of the Church. Wonderful. But said Pontifical Council has ZERO authority for interpreting the laws of Guam, which actually govern the legal status of that property (and, by the way, neither does the Denver law firm that Apuron hired). So what a bunch of b.s. 

Some other thoughts:

One
If there was nothing wrong with what the Archbishop did, then why did he hide it? Attached to the Deed Restriction is a Decree of Designation. A Decree is a public announcement. Yet not only did Apuron NEVER announce the designation, he didn't even tell the members of his own finance council. In fact, he didn't tell anyone but his neo buddies. And what's more, after restricting the property he went on to chide, insult, berate, and ultimately fire the members of the finance council who opposed him. 

Two
The idea that Archbishop Apuron is in control of anything is a joke. Even if the legal opinion is right and the archbishop "retains substantial authority". It does not account for WHO "retains substantial authority" over him. And this is the root of the problem. Apuron will obey his neo masters. They will tell him NEVER to give back the property to the Archdiocese of Agana and he will obey.

By the way, Archbishop, is this why you have been "raising money"? How much of our money did you use on this very expensive law firm? Or was that Kimchee's (parents') money that you bilked her out of? What did you do, promise her more indulgences? She talks, you know, a lot! The other day she was bragging to a whole table at a hotel restaurant about how much money she gave you. She even said it was for "an American lawyer."

P.S. Tell Wadeson to say he's innocent, not just that the charges were "unfounded."

P.P.S. BTW, Archbishop, do you recognize these words:
"Therefore we cannot sign the letter you drafted because it is not true." 
I have the letter. Do you want me to tell people the rest of the story...or will you?

  1. Fr. Luis Camacho, first local priest formed at the Redemptoris Mater Seminary, has fallen. By this de facto, close down RMS and turn it into a homeless shelter because you never fixed up Guma' San Jose, Archbishop Flores' parents' house. Two, assign Wadeson down to Malesso' and see how they like it...I am sure the parents would support it since the SVD order and Los Angeles do not want him. Go ahead and do what you want Apuron because you are always right! And never mind the people because they'll always be dumb sheep anyways. So people of Guam, just play dumb that you don't know anything....bunch of pathetic losers we are and that's just what they want...to manipulate

  10. Letter drafted by apuron which coerces and dictates the American donor of Yona property to change her intent in order to save his ass. He wanted her to change from the seminary benefitting "Diocesan" seminarians to benefitting "rms" seminarians. This is old news but for the sake of many who might not know, it has to be mentioned. This is horrendously unethical, and not only makes him a liar but makes him guilty of effective interference in the growth of Diocesan clergy and vocations. This is an outrage that people ought to be alarmed and inflamed about.

The KIKO Making Machinery under the guise of RMS Seminary (meant to ordain missionary Presbyters will remain in Guam and will soon take over 100% of the Catholic Parishes on Guam. Does not pass the common sense test when we have fully qualified and well grounded Diocesan and Franciscan priests serving as Assistant / Associate Pastors; while these NEO Presbyters fresh out of the seminary are serving as pastors. Some of these pastors have ridden themselves of the parish counsel; so there is no local voice or representation on how the parish assets are used or abused.....STOP THE MONEY UNTIL all of the NEO Presbyters do as they are called to do which is to leave the island on mission where the Gospel (Good News) according to POPE KIKO has not been heard. The island has and will continue to follow the Good News taught by the the legitimate Pope named Frances who is the successor of Saint Peter.     2. Richard, you got that right brother! You would have gotten a good laugh from presbyter Mike at the CB 7:00 mass last night when he made a pitch for the annual appeal. He started off by saying the money is going to help them minister to the sick and imprisoned. He attempted to quote what Jesus said relative to this but he mumbled something about sheep and couldn't come up with what Jesus said. He was trying to cite Matthew 25:36 but it was an epic fail!! He then said that part of the money is going to RMS (after a short pause) then mentioned the JP ll Seminary. He said his spiel was only going to take a minute but lasted five minutes with his bumbling message. Hilarious!!

    3. YES....STOP THE MONEY. Some worry about the non neo priest, their non neo parish, or the people who benefit from the charities. If that's the focus of your worries about withholding $$, then you don't see the big picture. These NCW invaders will thrive as long as Apuron has money coming in to keep the local church afloat; wether neo or non neo parish. There are two ways to protest that will make a difference.
      1) Show your face and make your voices heard with signs; signs that say it like it is, not in a soft careful manner. Standing in the streets so the press can see the signs and anger from the parishioners. Demand it!
      2) It's simple...NO MORE MONEY...NOT ONE CENT TO ANY COLLECTION. NO SIDE FUNDS TO HELP NON NEO PRIEST. ALL PARISHES AND PRIESTS (NEO AND NON NEO) MUST SUFFER UNDER APURON'S DICTATORSHIP.

      Doing just one of these in full force will eventually bring this nightmare to an end.

  12. I say, use the money from the sale on education. Send young men to a seminary where they will learn to be holy and learned priests, then contribute to the Catholic schools who are struggling to pay debts, sponsor scholarships to deserving children in Catholic schools, send adult Catholics to updating conferences, help older religious men and women. So much good can come out of the sale rather than house ungrateful foreigners who are simply eye candy for apuron.

Tim, reference the exchange of letters between Apuron and the American donor of the money to purchase the Yona property, which ended with the donor refusing to sign the letter prepared by Apuron, would it be possible to publish both letters in full for all to see in Jungle Watch? Shouldn't the mainstream media get copies of these, also?

  20. Those who supported the dictator in life will have no place in the chancery after the fall. Best to leave the chancery now to make a statement you do not support the dictator. Remember there are greater number of years ahead post tony. He is already history. Advise to chancery staff is to leave now before the fall. After you will be identified as part of the dictators cabinet.

    1. Many of Chancery personnel have been loyal to the Catholic Church for many years and are deserving of our respect. Due to the cloud of suspicion during apuron's administration, however, they should all tender voluntary resignation letters in deference to the new Archbishop. It only makes sense that the incoming leader starts on a clean slate and is given free rein to form his team above any reproach and suspicion. No one is indispensable, and good sense dictates it. Apuron has been history and does not have de facto moral credibility as spiritual leader. Why he clings to the position (because he can, due to oversight of Vatican policy) remains a puzzlement and anger to the rest of the consituents, not to mention embarrassment for the Guam Catholic Community.

    4. We know and appreciate the service of our Chancery personnel. Their dedication to duty has been stellar in the swirl of smoke around the chancery admin. They have tried to remain neutral and do their work without taint, but with the head always running his mouth and making disparaging and insolicited remarks about others, it must be a bitter pill to sit and pray during their gatherings. Yet these people make it work so they can serve us well. Only a handful of rotten eggs that coddle this pitiful excuse of a man do not reflect the pure and simple intentions of many. And we know who these rotting vermin are.

I believe there comes a time for the common good of the people of Guam when we must even sacrifice our own security to remove the evil dictator. To remain at his side supporting a reckless callous and evil a use of power and position is not a part of our church. I understand you, I pray for you, but you are better off working for gov Guam than an evil vile dictator.
