  1. Why cc the Archdiocese? This is a matter between Tim Rohr and Fr. Edivaldo. This will be fun to watch if and how the Archdiocese will intervene.

  3. The way this letter is drafted is very interesting. You can tell Edivaldo is not the one that wrote it.
    It is a typical legal mumbo jumbo. It establish that Tim operates a website, that said website used his image and "likeness" without authorization, and gives a delay for the action.
    Also site a Guam legal opinion.
    A graphologist would also have fun with that signature.
    Ummmm Pius got the lawyers to circle the wagons.
    Frankly as usual they use something that is very flimsy....to test the waters..... Don't they ever learn?
    Tim is right: bullies and thugs....in Pius case it would be Thug, bully +++ many more flaws.

    7. By RMS standards, he is fully baked. He even studied "the family" in Rome. You can tell. He loves his family in Brazil. I was studying the picture. Don't you have any male cousins Edivaldo? How cone they are not in the picture with you silly boy and your silly girls? Quite certain the Secretary, and visitors were by no means impressed. We certainly are not. For me, I am repulsed.

    1. AND, he is an important and constant travel companion along with Harold ( I hope you know who he is!!) of our Archbishop. He is an Arcdiocesan Presbyter who on his letter full of legal threats, cannot seem to spell ARCDIOCES! Archdiocese, Edivaldo. And while you are at it take that image of you dangling a dripping wet little baby boy in the air while you dance around with your friends to the sounds of Hebrew music. I hope this Baptism was not Private in community, but in A Catholic Church. You don't play well on You Tube either. Enjoy the Pope for the third time in only months time. You are spoiled. I hope that baby boy doesn't threaten to take legal action against you.

    If you want privacy get rid of your social media accounts, and remove yourself from your ministry. Post signs, no pictures please, and no bad talking about me cause I am sensitive.

    If people take photos of you at mass, at a dinner, at a beach, at a Karaoke Club(which I've seen you and your "brother priests", or at a party guess what- they are free to do with it as they please. 1) you are not a celebrity, 2) Tim is not making money off your likeness 3) Your image is not trademarked or registered 4) you have to prove relevant harm by use of the likeness. 5) you're a douche (I put that in there) . 6) nobody other than you cares. You need to sue the person who 1)took the photo, 2)distributed the photo or posted it.

    Besides-postings on your social media account becomes free reign on who can copy and take it. Heck i can create a whole fake profile with you in it.

    Here is what the U.S. Law says and the U.S. Courts-

    When using photographs that you did not personally take, you need to worry about copyright law in addition to name or likeness issues. Getting permission from the person depicted in the photograph only stops a claim for misappropriation or violation of the right of publicity. For details on getting permission to use a copyrighted work, see "Copyright Licenses and Transfers" and "Free Expression Limitations on Liability."

    Please keep in mind that stock photo services, creative commons licenses and public domain repositories of images are not subject to fair use due to the rights they carry.

    Stock photo services require you to pay for a license, creative commons licenses confer the right to use an image under certain circumstances and public domain images (Such as Social Media) are not subject to copyright in the first place.

    Its a stretch to prove Defamation and Libel since most people don't care for you so how do you prove damage to your "reputation".

    My Advice- get a better lawyer than Jaque Terlaje, she'd not a very bright lawyer or person. Good Luck but you will find no friends or law that would protect you.

    1. And Guam law only addresses images which are "unlawfully intercepted". Be careful who you friend if you don't want them sharing your pics. But Edivaldo is quite proud of his harem, and I'm not referring to the girls in the pic.

    4. To show that I am both fair and informed, the "engaged" would refer to his probably having been ordained a transitional deacon and "married" would or should refer to his priestly ordination. Unfortunately, with Edivaldo, we have to guess at these things.

      But permit me to be even more fair. It is the normal duty of those who run seminaries to either screen people like Edivaldo out before they can do damage to themselves and to others, or to set them on a corrective course with several opportunities for professional checks.

      Instead all we have is Gennarini deciding everything. Ultimately, the damage done not just to the Catholics of Guam by "RMS presbyters gone wild", but also to the presbyters themselves, is on Gennarini's soul and those who conspire with him to push these guys through their RMS mills around the world so they can buy more weak bishops.

  12. Dear Mr. Rohr,

    The moment he posted his picture on his FB account, the picture becomes part of the public domain. He therefore forfeits any privacy rights, if he had any in the first place. In fact, because the picture included more than one person and was taken in a public setting, then it immediately became part of the public domain. The moment any of the subjects start showing the picture to anyone else, it becomes part of the public domain. Either way Fr. Edivaldo cuts it, he looses. The only way he could have protected his privacy was not to have the picture taken in the first place. But hey, let him sue! You will then have the right to depose him, all the girls in the picture, their families, and inspect his financial records and anything else under the sun! Perhaps you would then find out(and enlighten us all) the source of his illuminating statement, "suck the sweet juice out of you". Gosh, I can't wait!!!!!!!

  17. As a seminarian if he didn't like you, he'd taunt you. He was this way especially towards some Asian ethnic groups. My spouse used to ask me to run interference against him if he came near her group, a standing order to this day.

  21. Yes please get an attorney who can spell Archdiocese vs Achdioceses. They should know how to cite Guam law as well. But given Apuron's example, the statute is "somewhere", you'll just have to look for it. Shall we establish a count-up for that too?

  24. My wife and I were watching on youtube the Holy Father meeting with the families in the Philippines. Towards the end when the Holy Father is leaving, Edivaldo appears at 1 hour 56 minutes. He came out rushing desperately trying to to kiss the ring of the Holy Father. He was the only priest that did this. This reminded me how AAA was rushing to see the Holy Father to give him an envelope. How sad they are trying so hard to get the attention of the Holy Father.

  25. I hear tell that during the day at the Chalan Pago parish, Edi walks around in tight shirts and extremely short shorts, (ugh, just had a visual). I don't think that is proper attire for anyone that is running a church, but then again, he's not a real priest.
