STATEMENT. (I'LL BE BACK WITH MORE INFO LATER)

Announcement
On the Property used by 
Redemptoris Mater Seminary (RMS) and Blessed Diego Theological Institute (BDTI)

Today, I will provide an update to the faithful and people of Guam concerning the Yona property used by the Redemptoris Mater Seminary (RMS). Allow me to give some background. The Yona property was acquired by the Archdiocese of Agaña, but in 2011 the use, and control of the property, was ostensibly conceded in perpetuity to the RMS, through the Declaration of Deed Restriction recorded in the local Department of Land Management. Unfortunately, such a concession has become a source of grave dispute and division within our Church. 


I am pleased to announce that the Archdiocese of Agana, through Archbishop Michael Jude Byrnes and concurred by Archbishop Savio Hon, with advice and support of both the Archdiocesan Finance Council and Presbyteral Council, has acted to transfer complete and unrestricted control and possession of the Yona property back to the Archdiocese of Agaña.

As you know, Archbishop Apuron was relieved of his pastoral governance on June 6, 2016 and is no longer in a position to civilly and ecclesiastically exercise the authority of the Archbishop of Agaña. Then immediately, by the special mandate of Pope Francis, Archbishop Hon was then appointed Apostolic Administrator to replace Archbishop Apuron in exercising the full authority of the Archbishop of Agaña, civilly and ecclesiastically without exception, until further decision of the Pope. Then, on October 31, 2016, the Holy Father gave a more permanent solution and appointed Most Rev. Michael Jude Byrnes as Coadjutor Archbishop of Agaña with Special Faculties to replace Archbishop Apuron in exercising the same authority of the Archbishop of Agaña, civilly and ecclesiastically without exception, while having the right of succession. Archbishop Hon concluded his mission as Apostolic Administrator and has been asked by the Holy Father to represent the Holy See for the ordinary administration of the Archdiocese of Agaña so as to assure a smooth transition. 

With the signed concurrence of Archbishop Hon, Secretary of the Congregation for the Evangelization of Peoples, in his capacity as authoritative representative of the Holy See, Archbishop Byrnes, upon the instructions of the Holy See, has signed all legal documents and executed all due procedures. These documents have been filed and recorded with the appropriate Government of Guam agencies, to effectuate the reversion of the Yona property back to the full control and governance of the Archdiocese of Agaña. 

In summary, the legal filings abolished the RMS Board of Guarantors, and replaced the current Board of Directors with Archbishop Byrnes as the Sole Director, as well as designated him as the Chairman, President and Secretary of the RMS corporation. Archbishop Byrnes also signed documents cancelling, rescinding and annulling the 2011 Declaration of Deed Restriction.  He also executed a Grant Deed transferring the property back to the Archdiocese of Agaña, to the extent that the RMS had any interest, all in accordance with the instructions of the Holy See under the authority of the Pope.

In this way, while expressing thanks to the two above-mentioned Boards for their care and work for the RMS, Archbishop Byrnes endeavors to regain greater freedom and flexibility to restore unity of the Church by undoing the above-mentioned "Deed" which was the source of division and conflict in the Archdiocese.

As Catholics, we must subscribe to the doctrine of Papal Primacy, which states: 

The Pope, Bishop of Rome and Peter’s successor, is the perpetual and visible source and foundation of the unity both of the bishops and of the whole company of the faithful. For the Roman Pontiff, by reason of his office as Vicar of Christ, and as pastor of the entire Church, has full, supreme, and universal power over the whole Church, a power which he can always exercise unhindered. Catechism of the Catholic Church #882.  

In accordance with these teachings, we as Catholics must abide by and be obedient to the wishes and directives of our Holy Father, Pope Francis. 

For the unity of the Church, as Catholics let us follow the guidance of the legitimate authority of the Church, namely Archbishop Hon, authoritative representative of the Holy See, and in particular Archbishop Byrnes appointed by the Holy Father to exercise the authority of the Archbishop of Agaña. 

Under the Motherly care of Our Lady of Kamalen, let us be one in Christ and move forward in the unifying journey of healing and reconciliation.

  1. So it looks like we get the Yona property back under the patrimony of the Archdiocese of Agana-- without a lawsuit! Without a lawsuit instigated by our side, of course. Wouldn't it be such fun for us if the Neos Board of Governors would sue the Archdiocese of Agana to reinstate the Deed of Restriction issued by apuron in favor of the Neos?

  5. the transfer to rms was a conveyance in fee simple. and the rms is a separate entity under guam law. doesn't that mean that archbishop byrnes can't just unilaterally transfer the property back to the archdiocese? or did the rms board of guarantors (ie, the gennarinis) agree to convey it back?

    1. It's too bad the archdiocese did not put someone from the finance council up there to explain it. Here's what happened. Byrnes cannot unilaterally transfer the property back. What he could do and what he did is the same thing Hon did with the cemetery board. He fired them and replaced them. He can do that because he is the sole incorporator. He replaced them with himself and then signed the documents as "the board" of RMS conveying the title back. The fly in the ointment was the Board of Guarantors. They could still sue. However, the bet was that they wouldn't. This has gotten way to hot for them. More later.

      at this point, this is all past, but this re-conveyance completely invalidates hon's initial insistence that there was "no doubt" that the yoña property still belonged to the archdiocese. at least he's come around since then. but i bet the neocats will keep on saying, "see, the archdiocese always owned it."

    The Gennarini's have lost,
    Apurun paid a high cost.
    Will Yona become a peace institute?

    Peace and unity was Hon's great desire.
    But he couldn't quench the hot Kiko fire.
    Through so much deceit,
    friends of Tony taste defeat,
    And a Carmelite proves Apurun a liar!

    This has been a huge day.
    A black eye for "the Way".
    The truth is now out,
    with great joy we can shout!

    1. Yes, don't forget the unforgettable fantasy by Dakon Frank Tenorio. The old man tried to defend the bishop who always protected his own financial crimes. Through the looking glass, we could see Fr Monkey, carefully pacing and directing the drama. Dakon Frank delivers the critical line... "I was in Agat from 1973 to 1977. So I was there. I know it never happened."

      Fr Monkey celebrates with a burst of joy and a great fist-pump, much to the horror on the Dakon's face. The Dakon now realizes he was used, but hey, that's ok. After all, Apurun has always protected him.

      Only one question remains. If Dakon Frank was in the bed with Apurun when these sex crimes happened, who was with the Dakon's wife and family?

  14. I look forward to hearing what the neo "responsibles", "catechists", etc. tell their communities about these press conferences. I can only imagine how they'll twist the truth. I'm already hearing some neos saying Mother Dawn is lying. Total brain washing!!!

  15. Maybe the members of the Laity Forward Movement (LFM) can now make plans to have a Te Deum Mass (for Thanksgiving) AT THE YONA PROPERTY.
    Let us see who dares to turn them away this time!

    And LFM, if you plan to do just that, give all of us advance notice (not just one or two days via e-mail) so that we can all join you to give thanks to God.

    1. The orders to convey title to the property back to the Archdiocese of Agana came directly from the Holy See. Apuron had already been ordered to give the property back twice. He did not. Holy See authorized Hon and Byrnes to effect the conveyance. Byrnes legally had the authority to disband the RMS board and appoint himself to all the necessary positions on the board. He was then legally able to convey title back to the archdiocese.

      Because Guam law does not recognize the Board of Guarantors as having any authority to administer the legal aspects of the corporation, this board could have been ignored. But to assure that it was ignored, it was ABOLISHED.

      Gennarini's could sue but it would go nowhere. Plus, there is one other little piece of paper that cuts the nuts off the guarantors that I know about but haven't mentioned. (pardon the visual)
