NO MORE MISTER NICE GUY

Fr. Edivaldo da Silva Oliveira and Fr. Adrian Cristobal, priests of the Archdiocese of Agana, used the office of the Archdiocese of Agana to publicly attack me as follows:

On May 31, 2016, a Media Release was sent from the Chancery Office of the Archdiocese of Agana to the local Media. The email message to which the Release was attached identified the person responsible for the Release as:

Fr. Edivaldo da Silva Oliveira
ARCHDIOCESE OF AGANA, Media Relations
196 Cuesta San Ramon
Hagatna, Guam 96910-4334

The Release dealt with, inter alia, me, Tim Rohr, and states in pertinent part:

  1. Tim Rohr and his associates launched a vicious and calumnious attack on the Archbishop and the Church. 
  2. They demanded that the Archbishop return to the former ways of financial administration… 
  3. They wanted to sell the seminary in Yona… 
  4. The perpetrators of these calumnies have resorted to insults and violence revealing their true intention to destroy the Catholic Church…
  5. They have…cruel intent to injure the Archbishop, the Catholic Church in Guam and many other people of good will who have been outraged and harassed.

The accusations against me, Tim Rohr, contained in this May 31, 2016 Media Release, were published and/or broadcast in the local Media as follows:


In the Pacific Daily News, on June 1, 2016, under the title: "Archdiocese plans to sue for ‘malicious lies’ again":
“Tim Rohr and his associates launched a vicious and calumnious attack on the Archbishop and the Church,” the Archdiocese of Agana said. “They demanded that the Archbishop return to the former ways of financial administration, when the archdiocese was increasing debts every year because of mismanagement. They wanted to sell the seminary in Yona to cover the substantial debt accumulated by the previous administration of these three entities. The Archbishop was adamantly opposed to the idea of selling the seminary to cover these debts. Thus began a malicious campaign to denounce and attack the Archbishop at whatever cost to get him out of the way.”
 In the Guam Daily Post, on June 1, 2016, under the title: "Archdiocese responds to new allegation":
“Tim Rohr and his associates launched a 'vicious and calumnious attack' on the archbishop and the church,” the statement says. The statement also refers to the selling of the Yona seminary to cover debts incurred at the hands of the former administration. According to the statement, this was the beginning of the “malicious campaign to denounce and attack the archbishop at whatever cost to get him out of the way.” 
On the Pacific News Center, on May 31, 2016, under the title: “Archbishop Apuron Denies Sexually Abusing Doris Concepcion's Son":
The release blames catholic blogger Tim Rohr for "launching a vicious and calumnious attack on the archbishop and the church." The release says that the malicious campaign is in retaliation for refusing to sell the Yona seminary to cover debt from the previous administration. (The news item goes on to quote the May 31, 2016 Media Release from the Chancery in full.) 
On KUAM, on May 31, 2016, under the title: "Another allegation surfaces of molestation by
archbishop" wherein the full May 31 Media Release was published.

On June 5, 2016, the Umatuna Si Yu'os, the official newspaper for the Archdiocese of Agana, reprinted the May 31 Media Release in full under the title: "Archdiocese of Agana Statement, May 31, 2016 Attacks against Archbishop continue as predicted."

On June 3, 2016, another Media Release was sent from the Chancery Office of the Archdiocese of Agana to the local Media. The email message to which the Media Release was attached identified the sender as:

and referred questions to:

Referencing, again, the supposed plan to sell the seminary, the Release states in pertinent part:
"Tim Rohr…had a personal interest in this plan and was supposed to be involved in this multi-million dollar sale as a real estate mediator." 
The accusation against me, Tim Rohr, contained in this Media Release, was broadcast the same day on KUAM under the title: “Church says there's a plot to topple the archbishop.” 
"The church meanwhile is also accusing Martinez of being part of a conspiracy or the "Rohr Group" to topple the archbishop. Tim Rohr operates the JungleWatch blog, which has been critical of the archbishop over the last several years. The church further claims Martinez, who was the former archdiocesan financial officer was incompetent in his position and for six years in a row failed to submit required financial reports to the Vatican.  The archdiocese alleges this finance council conspired to sell the Yona seminary property in order to cover their financial misdeeds. So where does Rohr fit in? According to the church they alleged he had a personal interest in the plan and was supposed to be involved in the multi-million dollar sale as a real estate mediator." 
Both media releases, dated May 31 and June 3, 2016, were inscribed on what appears to be the official stationary of the Archdiocese of Agana and nothing in or about the release suggests that it is anything other than an official communication of the Chancery Office of the Archdiocese of Agana. Therefore I must treat the release as official and genuine. And because the release was intended to, and did, have broad circulation, I must treat both communications as an extremely serious matter. 

In addition, the accusation implying that I, Tim Rohr, was part of a conspiracy involving an improper and clandestine real estate transaction is libelous and injurious to my livelihood as a real estate salesperson.

Here is a summary of the accusations made against me by Fr. Edivaldo da Silva Oliveira and Fr. Adrian Cristobal:

Specifically, Fr. Edivaldo da Silva Oliveira accused me of: 

  1. launching “vicious and calumnious attack(s) on the Archbishop and the Church.”
  2. instigating a malicious campaign to denounce and attack the Archbishop
  3. wanting to sell the seminary in Yona
  4. having resorted to insults and violence
  5. having an intention to destroy the Catholic Church
  6. having a cruel intent to injure the Archbishop
  7. harassing many other people of good will

Specifically, Fr. Adrian Cristobal accused me of:

  1. orchestrating a conspiracy, which he calls "the Rohr Group" to topple the archbishop
  2. having a personal interest in a plan to sell the seminary in order to benefit as a real estate mediator

These two priests are at the root of most of the public viciousness in this diocese over the last three years as most of the news stories and media releases will show, and both were publicly and notoriously disobedient to the Pope Francis-appointed Apostolic Administrator, Archbishop Savio Hon Tai Fai. 

But, ultimately, it is the Archdiocese of Agana who is responsible for the defamatory actions of these two priests. The attacks were made in their capacities as Media Relations Officer and Chancellor, and the attacks were made on official Archdiocesan stationery. 

If I choose to, I will have the Archdiocese of Agana named as a defendant in a potential suit, but I prefer not to. I will give the Archdiocese of Agana, under its new leadership, the opportunity to do the right thing, and I do not want an apology. I am willing to discuss what I want privately with the Archbishop Byrnes or his delegate. 

Meanwhile, let me give a hint. I have intended to pursue this suit ever since the attacks were made. However, within a few days of those attacks, Apuron was removed and I decided to drop the effort. However, seeing this...

  2. rather suspect Archbishop Byrnes will be notified of other cases against the Archdiocese because of these named priests.
    Best interest of Archdiocese of Agana for them to leave Guam. Their presence will lead to legal cases. Remove them less chances of vases being filed.

    If Uduvaldo finds five benevolent bishops willing to take him under their care, would you spare him the lawsuit?

    Forgive me for my persistence, If Uduvaldo, but finds four bishops, would you spare him the lawsuit?

    But what if Uduvaldo finds only 1 bishop, like Bishop Ballin, would you spare him the lawsuit?

    What the heck Tim, let em have it, there is no compromising with people the likes of Uduvaldo and Adriana. These guys have no compassion and will not show mercy to anyone, their past actions have provided proof of their evil intent. They continue to display their arrogant actions, Please, Please, Please Tim, Let them havvvvve it......

  9. If Tim has material proof that his livelihood was significantly reduced by Waldo's libel, slander and defamation of character, he's entitled to sue. Too bad if the archdiocese gets kicked in the ass. Apuron asked for it.

    Was I right when I said the jug-eared jerk never left Guam? If not, where and when was that photo taken?

    Don't waste your time with them. They have embarrassed the NCW and they will be dealt with for lack of discernment. NCW will claim its all a little local spat and they will be fingered for any irrefutable evidence against the Way. It would be more satisfying to see them hung out to dry by their own.

    However, I see that a simple photo of Father Edivaldo has really gotten under Tim's skin. The photo of Father Edivaldo in prayer has gotten Tim so riled up that he is thinking of a lawsuit.
