Cathedral may face penalties if pay checks withheld

A MEMO dated Aug. 4 from the Dulce Nombre de Maria Cathedral-Basilica’s new rector to cathedral employees advised against reporting confidential information and said payroll checks from earlier that week would not be released until employees acknowledged the confidentiality notice.
Withholding earned salary, however, is against Guam labor laws, according to Department of Labor Director Manny Cruz. “It’s a violation. He cannot withhold it because you already earned it,” Cruz said. “He has to release that.”

  1. I don't know how true Father Adrian's remark is on this article. All I know is the employees were told to report daily to the Chancery after Msgr. James was issued his letter of removal. So for Adrian to say he doesn't know anything is probably hog wash. There is the possibility that he does not want to incriminate himself.

  2. Anonymous (August 28, 2014 at 7:16 AM), I, too, found the remark attributed to Fr. Adrian curious. Was he kept out of the loop to avoid any more comments about that "blog somewhere"? Or is it as you suggested — his desire to avoid self-incrimination?

    I also found it curious that this story wasn't featured on PNC or KUAM when it first appeared on the blog. I wonder if the other media outlets will pick it up now that MV-Guam broke the news.

  3. Our Archbishop signed the letter. Is that not connection to the Chancery enough for Fr. Adrian to know about this?

    Point of information, what exactly is Fr. Adrian's administrative role or title in the Archdiocese?

    1. It is that of Chancellor, kind of like a Sargent at arms. He is also Pastor at Barrigada. He is also Vocations Director. He is also spokesman.

  4. Mary Lou, good point. Adrian may know best not to mess with the Feds. It may also be that he has so many issues to clear up in the chancery he may not want to involve himself in parish issues. Suspect it is the former.

  5. How does this labor issue impact the ability to bring in foreigners for the seminary? If they are withholding wages, then the Archdiocese should also be reported to US Immigration as a poor employer. The neo priest and seminarians are on visas to come into the US. The Arch is the sponsoring agent and doing illegal activity it will impact immigration . An investigation needs to be done.

    1. They are working on papers to make them U.S. citizens ASAP. I belief that some of them this status already. They try to do it before ordination!

  6. Guam DOL needs a complaint filed before proceeding with an investigation? Consider it done! I will contact local DOL after lunch. Let the investigation begin!
    If the archbishop and David do not release those checks after that article they are NUTTY.
    By the by, federal DOL has a copy of the letter. Who emailed it to them? Guilty!!!

    1. Thank you, Eileen, for keeping right on top of this matter and holding the Archbishop and the Vicar General accountable for their actions!

      BTW: It's interesting that "Diana" has not addressed this issue of withholding wages on "her" blog — but if their past actions are any indication, there will be more attacks by and/or threats from the "Kikos/Kikobots."

  7. Just checked Guam DOL Wage & Hour Division's website. There is a complaint form that's filled out by the employee/ex-employee. Hmm, since I am not a Cathedral employee/ex-employee, I cannot file a complaint. Will call Roman Quitugua to see what I can do as a concerned resident of Guam fighting against the dastardly dealings of employers who are bullies.

  8. A Archbishop should lead by example, and be a beacon for inspiration on how to live our lifes.
    Just as the Archbishop of Rome has tried to remind us for the last year.
    This Archbishop by choosing to become just another member of the Way, and subject himself to the diktat of non ordained personnel like the
    Genarinnis and other Kikos, not only has failed in his mission to lead by example, but also has betrayed the trust given to him by the Pope, and betrayed the faithful of the Catholic Church on Guam by abandoning his flock.
    He, de facto, has surrendered his decision making by bowing to outside forces, who at best do not have the interest of our Church to heart.

    Furthermore his actions have allowed for many wrongdoings and illegal activities under his watch, or worse with his full participation.
    This latest issue is only the tip of the proverbial Iceberg.
    It is alleged that there are filling of false immigration documents, or the filing of false statements to file said documents.
    It is alleged that the Archdiocese fails to follow State and Federal labor laws

    There have been several incidents of trying to file false financial statements to change existing documents, and defraud the holdings in place.
    There have been countless numbers of false and misleading statements to the press regarding People and situations the Archdiocese is involved with.
    It is alleged as well, that staff of the RMS are kept on payroll while they do not perform any work. Some have not been on the island in years.
    It is also alleged that countless expanses are charged to the Archdiocese for travel to and from Guam by non members of the Archdiocese, and that there is rampant nepotism in the attribution of contracts by the Archdiocese.
    Finally there are strong evidences of continued cover up of facts in regards to financial decisions by the Archbishop, and in regards to priests that have been sheltered by the Archdiocese knowingly while under strong suspicions and sometimes direct accusation of inappropriate sexual behavior.
    It has been alleged recently that the Archbishop and the RMS conspired to extract under secrecy Fr. Wadeson to destination unknown with the help of the Gennarinis,
    By themselves each of these accusations or alleged misbehaviors could be construed as simple errors or mismanagement lapses.
    Unfortunately when you add them up together, you clearly see a pattern of lies and deceptions that are not accidental.

    Overall this is a colossal moral failure.
    What is even more painful is that this also could be a criminal pattern in respect to the law.
    Les we pray for guidance by the Holy Spirit of other leaders of our Church to help us find a door to a permanent solution to these evil deeds.
