BILL 168-33 PASSES

Meanwhile, as we have pressed forward on cleaning up the Archdiocese of Agana, we have remained active (although quietly) on the effort to clean up Guam's thriving abortion industry.

For more than 20 years Guam's abortionists have selectively ignored practically the only law Guam had relative to regulating their industry and that is the abortion reporting law. 


Thanks to Senator Frank Aguon, Jr. and members of his staff, the Esperansa Project was able to craft legislation which will hold abortionists responsible and liable if they continue to violate the law. The bill, Bill No. 168-33 recently passed in the legislature and it now awaits Governor Eddie Calvo's signature.

Abortion Reporting Strengthen with Enforcement Mechanisms 
“It is remarkably clear that past abortion reports that were submitted to the Office of Vital Statistics by these current abortion providers have been incomplete and non-compliant with the abortion reporting laws.  Bill 168 would allow us to address the loop holes within current statute by adding mechanisms to better ensure enforcement."

A complete individual abortion report for each abortion must be completed under penalty of perjury and filed with the Territorial Registrar of Vital Statistics by the mother’s attending physician.  This past session of the 33rd Guam Legislature saw collective support for the strengthening of abortion provider reporting requirements.  Bill 168-33, if signed into law, would mandate all abortion reports be signed by the attending abortion physician under penalty of perjury and filed with the Territorial Registrar of Vital Statistics within seven (7) days from the date of the abortion.  

The enforcement mechanisms in this measure would require the Territorial Registrar of Vital Statistics to promptly report to the Attorney General of Guam and the Guam Board of Medical Examiners any violations of filing the abortion report and compliance with the Women's Reproductive Health Information Act.

“It is remarkably clear that past abortion reports that were submitted to the Office of Vital Statistics by these current abortion providers have been incomplete and non-compliant with the abortion reporting laws.  Bill 168 would allow us to address the loop holes within current statute by adding mechanisms to better ensure enforcement,” Senator Aguon said.  “Abortion reporting is key to monitoring changes in clinical practices, tailoring public health interventions for at risk populations, and at the most basic level, monitoring access to care.”
